  • You grant them a broad, perpetual license to use content you upload, even after deletion in some cases.
  • Your disputes are limited to specific courts in California, and Meta limits its legal liability to $100 or what you have paid.

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to give Meta a broad, sublicensable license to your content that may persist if third parties have used it.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on Facebook, you give us permission to store, copy, and share it with others... such as Meta Products or service providers that support those products and services. This license will end when your content is deleted from our systems.”

What that means: Meta can share your uploads with third-party partners and continue to hold rights to them even after you try to delete them if others have interacted with them.

The license is broad enough to allow sublicensing to partners and service providers. It also allows Meta to keep using the content if others have accessed it under this license before deletion, creating a gap where the license persists beyond user control.

High cost

Difficult or incomplete deletion

You are agreeing that your data will remain in backup and disaster recovery systems for up to 90 days after your deletion request.

“It may take up to 90 days to delete content after we begin the account deletion process or receive a content deletion request. ... After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data remains recoverable in backup systems for months after you request deletion, violating a complete right to be forgotten.

Full erasure, including backups, requires up to 180 days. The text explicitly states retention in backups prevents immediate full deletion.

High cost

Liability shifted onto the user

You are agreeing that Meta's total financial responsibility to you is capped at $100 regardless of the severity of the harm.

“Our aggregate liability arising out of or relating to these Terms or the Meta Products will not exceed the greater of $100 or the amount you have paid us in the past twelve months.”

What that means: If Meta's actions cause you significant harm or data loss, their contract limits their payment to you to just $100.

Even for negligence, Meta caps its maximum financial liability at an extremely low figure ($100), leaving users with no practical recourse for damages.

Medium cost

Terms follow you to parks, stores, and other products

You are agreeing that one set of rules applies to Facebook, Messenger, and all other Meta products.

“These Terms ... govern your access and use of Facebook, Messenger, and the other products, websites, features, apps, services, technologies, and software we offer (the Meta Products or Products)”

What that means: One agreement binds you to a vast network of Meta apps and services.

A single acceptance covers the entire suite of Meta ecosystem products rather than individual apps.
