What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to give Meta a broad, transferable license to use, modify, and sublicense your content worldwide.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content”

What that means: Your creative work can be used by Meta's partners or sold to third parties indirectly through sublicensing, limiting your control over your own media.

The contract grants Meta a broad, transferable, and sub-licensable license to your content. This means Meta can allow other companies or partners to use your photos and videos, even after you delete them from the main platform until backups are cleared.

High cost

Liability shifted onto the user

You are agreeing to waive warranty claims and accept that Meta's liability for damages is severely limited.

“we make no guarantees that they always will be safe, secure, or error-free... DISCLAIM ALL WARRANTIES... liability shall be limited to the fullest extent permitted by applicable law.”

What that means: If the service fails, leaks data, or causes issues, you likely cannot sue for damages beyond what local law minimally permits.

The service is provided 'as is' with no warranties. Meta limits its financial liability to the maximum extent allowed by law, effectively shifting the risk of service failure or harm onto you.

High cost

Terms follow you to parks, stores, and other products

You are agreeing to abide by supplemental terms for Avatars, AI, and Music content if you use those features.

“if you post or share content containing music, you must comply with our Music Guidelines. If you use Avatars, then the Avatar Terms also apply. If you use our AI products and features, the Meta AI Terms also apply.”

What that means: You are subject to a complex web of supplemental agreements that may contain stricter rules than the main Terms.

Using one product like Facebook or Instagram may bind you to additional, separate terms for specific features or affiliated services like Avatars, AI, and Music.

Medium cost

Difficult or incomplete deletion

You are agreeing to wait up to 180 days for your data to be fully removed from all systems including backups.

“it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data persists on company servers long after you believe it is gone, making true 'right to be forgotten' claims difficult.

After you request deletion, your data remains in backup systems for up to 180 days total (30-day trash + 90-day processing + 90-day backup removal). Deletion is not immediate.

Medium cost

Tracking you across apps

You are agreeing to have your activity and interests tracked and analyzed to serve personalized advertisements.

“We use your personal data, such as information about your activity and interests, to show you personalized ads and sponsored content that may be more relevant to you.”

What that means: Your online behavior and interests are tracked to build a profile for targeted advertising.

The terms explicitly state that user activity and interest data are used to personalize ads. While they claim not to sell direct identifiers, the profiling for ad targeting constitutes cross-app/site tracking behavior described in their Privacy Policy section referenced here.
