What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Broad license to user content

You are agreeing to grant Meta a broad, sublicensable license to use and distribute your content.

“you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings).”

What that means: Meta can use, copy, and share your photos and videos with third-party service providers or other apps in the Meta family.

The document grants Meta a broad, perpetual, and sublicensable license to user-generated content. While the license ends when content is deleted from systems, the terms allow Meta to use the content broadly across its network.

Medium cost

Tracking you across apps

You are agreeing to allow Meta to track your activity on and off its products for ad targeting.

“We use data about the connections you make, the choices and settings you select, and what you share and do on and off our Products - to personalize your experience.”

What that means: Your activity outside of Facebook is tracked and used to determine which ads you see.

Meta collects data on user activity both on and off its products to build profiles for advertising purposes.

Medium cost

Difficult or incomplete deletion

You are agreeing that deleted content may remain in backups and with other users for extended periods.

“After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.”

What that means: Your data is not immediately erased and may linger in backups or in the accounts of other users long after you request deletion.

Even after an account deletion process begins, data remains in backup systems for up to 90 days, and content shared with others may persist indefinitely until those users delete it.

Medium cost

Liability shifted onto the user

You are agreeing to limit your ability to recover damages from Meta to a maximum of $100.

“our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data... Our aggregate liability... will not exceed the greater of $100 or the amount you have paid us in the past twelve months.”

What that means: If Meta fails or loses your data, you cannot sue for more than $100 in compensation.

Meta caps its financial liability to you at $100 or what you have paid them, excluding significant damages like lost data or profits.

Medium cost

Third parties handle data you submit

You are agreeing to let Meta share your content with third-party service providers.

“This means, for example, that if you share a photo on Facebook, you give us permission to store, copy, and share it with others... such as Meta Products or service providers that support those products and services.”

What that means: Third parties may handle your private photos and videos.

User content is shared with third-party service providers and other Meta products to facilitate service delivery.

Lower cost

Unilateral changes with little or no notice

You are agreeing to accept future changes to the Terms by continuing to use the service.

“Unless otherwise required by law, we will notify you before we make changes to these Terms and give you an opportunity to review them before they go into effect.”

What that means: Terms can change, and your continued use signifies acceptance without a new signature.

Meta provides notice of changes but binding occurs through continued use rather than explicit re-consent for every update.
