In short

  • Headspace Terms & Conditions allow you to use their meditation app, coaching, and therapy services.
  • You accept mandatory arbitration for disputes, automatic subscription renewals, and broad rights for Headspace to use your user submissions.
  • The terms also require you to assume risks related to health and content, as the service is not a substitute for medical care.

What you accept

If you tap Agree

Everyday words for the material promises and rights you give up. Each line includes a quote from the document.

  1. 01

You are agreeing to resolve disputes through binding arbitration rather than public court or class actions.

    This product

“YOU AND HEADSPACE AGREE THAT DISPUTES RELATING TO THESE TERMS OR YOUR USE OF THE PRODUCTS AND SERVICES WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.”
  2. 02

You are agreeing to pay automatically renewed subscription fees unless you cancel before the renewal date.

    This product

“The Subscription will continue unless and until you cancel your Subscription or Headspace terminates your Subscription or your account.”
  3. 03

You are agreeing to grant Headspace a perpetual, worldwide license to use and commercialize any content you submit.

    This product

“by submitting User Material you hereby grant Headspace an irrevocable, perpetual, non-exclusive, royalty free, worldwide license to use... in any manner (including, without limitation, for commercial... purposes)”

What it can cost you

Downsides we could quote

Quoted clauses that can affect your privacy, money, or right to go to court — including terms that follow you to other products.

Highest-cost clauses first

High cost

Forced arbitration or class-action waiver

You are agreeing to waive your right to participate in class-action lawsuits or public court proceedings for most disputes.

“EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION CLAUSE, YOU AND HEADSPACE AGREE THAT DISPUTES RELATING TO THESE TERMS OR YOUR USE OF THE PRODUCTS AND SERVICES WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.”

What that means: You lose the right to sue in court or join class actions against the company for issues like billing errors or service failures.

The document mandates that all disputes go to private arbitration, preventing you from joining a group lawsuit or having a judge/jury decide your case in public court.

High cost

Jury trial or court access waived

You are agreeing to give up your right to a jury trial for disputes subject to the arbitration clause.

What that means: You cannot demand a jury of peers to hear your complaint; a private arbitrator decides the outcome instead.

By entering binding arbitration, you implicitly waive the constitutional right to a trial by jury for covered disputes.

High cost

Auto-renewal or hard-to-cancel paid terms

You are agreeing to auto-charges for recurring subscriptions and acceptance of no-refund policies for these charges.

“Free Trials automatically convert to a paid annual or monthly subscription term after a certain period of time. Your account will be charged automatically on the date when you purchase your first subscription to the Product or Service (“Subscription Billing Date”) for all applicable fees and taxes for the next subscription period.”

What that means: Your credit card is charged repeatedly for subscriptions you might have forgotten about, with little chance of getting money back.

Subscriptions renew automatically by default. Free trials convert to paid plans unless you actively cancel within a specific window. Refunds are generally not available.

High cost

Broad license to user content

You are agreeing to grant the company a permanent, royalty-free license to use and sell your user-generated content.

“by submitting User Material you hereby grant Headspace an irrevocable, perpetual, non-exclusive, royalty free, worldwide license to use, telecast, copy, perform, display, edit, distribute and otherwise exploit the User Material you post... in any manner (including, without limitation, for commercial, publicity, trade, promotional, or advertising purposes) ... and to grant and authorize sublicenses”

What that means: You cannot control what happens to your creative inputs; the company can monetize your ideas forever.

If you post comments, images, or feedback, Headspace owns a permanent, worldwide license to use it for any purpose, including ads and selling it to others, without paying you.

High cost

You take the risk of injury or death

You are agreeing to assume all risk of physical injury or death while using the products and services.

“In no event will the Headspace Entities be liable for any death or bodily injury that you suffer, or that you cause to any third party, in connection with your use of the Products or Services or any activity you undertake in connection therewith.”

What that means: If you get hurt doing a workout recommended by the app, you cannot hold them legally responsible for medical costs.

The terms explicitly state that you bear full responsibility for any physical harm, injury, or death resulting from using the app, especially during movement exercises.

High cost

Liability shifted onto the user

You are agreeing to use the service at your own risk with no warranties from the company.

“THE PRODUCTS AND SERVICES... ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. HEADSPACE DISCLAIMS ALL WARRANTIES OF ANY KIND... HEADSPACE DOES NOT WARRANT THAT THE PRODUCTS AND SERVICES OR ANY PORTION... WILL BE UNINTERRUPTED, OR FREE OF ERRORS...”

What that means: If the service fails, gives wrong information, or loses your data, you have very limited legal recourse against them.

The company provides no guarantees about the quality, accuracy, or reliability of the service. They disclaim all legal warranties regarding fitness or performance.

High cost

Health or fitness data used beyond care

You are agreeing to the collection and processing of sensitive health information required for therapy and coaching services.

“You further acknowledge that your use of the Products and Services may require the collection of your health information. This health information may be considered sensitive under your local laws... In certain US states, this health information may be “consumer health data”...”

What that means: Your most personal health details are collected and processed, carrying higher regulatory scrutiny but also higher sensitivity risks.

Headspace collects sensitive mental health and wellness data, which is defined as consumer health data under various state laws. While detailed handling is in the Privacy Policy, the Terms confirm this collection is central to the service.

Medium cost

Unilateral changes with little or no notice

You are agreeing to be bound by future changes to the terms if you keep using the service after being notified.

“Headspace reserves the right to change or update these Terms... at any time. We may notify you of such changes via pop-up or push notifications within the Products or via email. If you continue to use the Products or Services after modification, you agree to abide by the modified Terms.”

What that means: Rules about privacy, payments, or usage can change without you explicitly clicking 'I agree' again.

The company can modify the terms whenever they want. Continued use of the service counts as your acceptance of these new rules.

Medium cost

Location or sensitive-data over-collection

You are agreeing to the automatic storage and charging of sensitive payment method information.

“In order to access the Products or Services, you may be required to provide your payment information. You agree to promptly notify Headspace of any changes to your Payment Method while any payments remain outstanding. You authorize Headspace or a third-party payment processor to charge all fees... to the Payment Method.”

What that means: Your financial instruments are linked to the account with automatic charging authority, increasing fraud risk exposure.

While not biometric, the collection of financial payment details and the authorization to store/update credit card info automatically constitutes sensitive financial data processing.
